IMPORTANT: PLEASE READ THESE OFFICIAL RULES BEFORE PARTICIPATING IN THE “NAME IT 2 CLAIM IT” CONTEST SPONSORED BY BADGER PADDLES. BY ENTERING AND PARTICIPATING IN THIS CONTEST, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE WITH THESE OFFICIAL RULES.

 

1. CONTEST PHASES:

1.1 The Contest consists of the following three phases:

(a) The first phase begins on January 22, 2015 and closes on March 30, 2015 (the “Submission Period”). During the Submission Period, individuals may submit one or more paddle names to the contest website. At the end of the Submission Period, a small selection committee will review all of the submissions and create a shortlist for online voting. The full list will be vetted by Badger Paddles to ensure that all names that make the shortlist meet Badger Paddles naming criteria as outlined in the contest rules.

(b) The second phase begins on March 31, 2015 and closes on April 9, 2015 (the “Shortlist Round”). During the Shortlist Round, members of the Selection Committee will meet and choose a shortlist of three to five names for the public to vote on.

(c) The third phase begins on April 16, 2015 and closes on May 1, 2015 (the “Final Round”). During the Final Round or voting phase, members of the public may vote online at https://badgerpaddles.com for one paddle name of their choice. The Paddle Name with the highest number of votes will be declared the winner. There will also be one random winner selected from the list of qualified voters.

1.2 The person who submits the winning name will be declared the winner and will receive the prize outlined in Section 6. If two or more entry forms are received with the same proposed name, the first entry form received will be considered.

1.3 One person will be randomly selected during the 3rd and final phase of this contest to declared a winner and will receive the prize as outlined in Section 6.

2. HOW TO PARTICIPATE

2.1 During the Submission Period, individuals may submit one or more paddle names online at https://badgerpaddles.com/name-it-2-claim-it/. Before submitting an entry, individuals are required to: (a) provide their name, email address, their state or province of residence, and their story/reason for choosing their paddle name submission; (b) read and accept these Official Rules; and (enter as the text as seen in the CAPTCHA image box on the entry form page (to ensure the entrant is a human individual and not a robot). Individuals may then click on the “SEND” button to submit an entry. Individuals may submit multiple entries.

2.2 During the Public Voting Periods, individuals may vote for the paddle name of their choice. All voting must be manual. No automated voting is permitted. Each eligible vote will be counted as an entry for the prototype paddle prize as stated in section 6.2. Before submitting a vote or entry (if eligible), individuals are required to: (a) provide their name, email address, their state or province of residence, and select one paddle name from the short list as provided; (b) read and accept these Official Rules; and (enter as the text as seen in the CAPTCHA image box on the entry form page (to ensure the entrant is a human individual and not a robot). Individuals may then click on the “VOTE” button to submit a vote/entry. Individuals may submit multiple votes/entries.

3. ELIGIBILITY:

3.1 This contest is open to all residents of Canada (except for the province of Quebec) and the continental U.S.A. only. Entrants must be 18 years of age or over (or having reached age-of-majority where they reside). Employees Badger Paddles, and their immediate family members (defined as those who are related to the entrant and/or living in the same household) are not eligible for the contest. All members of the selection committee and their immediate family members are also not eligible for the contest. The winning paddle name will be selected from the submissions received. The winning paddle name will be immediately adopted for the new Badger paddle and will replace the temporary “XXXXX-R” or “Paddle X” title.

3.2 The Sponsor (Badger Paddles) reserves the right to modify and/or use a different name other than the one selected at any time.

4. JUDGING:

4.1 The winning paddle name will be chosen by the public during an online voting contest based on a shortlist determined by the selection committee. To develop the shortlist, online submissions to the contest will be judged by Badger Paddles representatives and a panel of individuals including Preston Ciere of portageur.ca, Hap and Andrea Wilson of cabinfalls.ca, Kevin Callan (a.k.a. The Happy Camper), and Darren Bush of Rutabaga and Canoecopia. Entries will be judged on the name’s ability to capture the heart of canoeists and is best representative of the new Badger paddle design.

4.2   The public will vote for a name online at badgerpaddles.com during the public voting period. Once the winning name is selected (based on the highest number of votes during the final voting period) it will be submitted to Badger Paddles for immediate adoption.

5. TERMS OF USE FOR ENTRIES:

5.1 Individuals are asked to submit a brief explanation outlining the reason for the suggested name and why it should be chosen as the new name for the XXXXX-R paddle design.

5.2 All contest entries on submission become the absolute property of the contest Sponsor without any consideration (monetary or otherwise) payable to the contest entries except as provided in Section 6. Contest entries will not be returned and may be used by the Sponsor for any purpose and in any media in perpetuity. Entrants agree that, by entering the Contest, you irrevocably assign and transfer to Sponsor all rights, title and interest in the paddle name without limitation. Entrant must agree to execute any additional documents deemed necessary to effectuate such an agreement if such need arrises.

5.3 By entering during any phase of the contest, entrants also agree (a) to be bound by these Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins that Sponsor may use the winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law) if such need arrises. All federal, provincial/territorial/state, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on the prize are the sole responsibility of the prize winner. In the event that the final selected winner of any prize is ineligible, cannot be traced or does not respond within ten (10) days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor will award the prize the next potential winner in accordance with the Judging Criteria.

6. PRIZES:

6.1 The winner of the naming contest will receive a beautiful, cherry wood, laser engraved Badger Canoe Paddle to commemorate the naming of the new XXXXX-R paddle which will be shipped to the winner at the cost of the sponsor (within the limits as stated below). MSRP is approximately $139.00 to $169.00 CAD (depending on finish and final laser engraved design) plus the initial cost of shipping. All incidental costs that may arise and/or any expenses (e.g. taxes, duties, any and all extra shipping costs not accounted for at time of shipping from the Canada Post office in Huntsville, Canada, etc.) are not included and are the sole responsibility of the individual receiving the prize.

6.2 The winner from the “voting phase” of the naming contest will be randomly selected from the list of eligible voters. Those who are not eligible to enter may still vote and that vote will be counted, however they will not be able to receive any prizes and their vote will not be considered as an “entry” for the purposes of this contest. The randomly selected winner from the voting phase will receive the XXXXX-R prototype paddle (specifically, the exact paddle used in the promotion and media for this contest), valued at $125.oo CAD plus the initial cost of shipping. All incidental costs that may arise and/or any expenses (e.g. taxes, duties, any and all extra shipping costs not accounted for at time of shipping from the Canada Post office in Huntsville, Canada, etc.) are not included and are the sole responsibility of the individual receiving the prize.

6.3 Badger Paddles reserves the right not to award prizes, or to award only some of the prizes, for any reason, including if there are an insufficient number of paddle names received during the contest

7. SELECTION OF WINNERS:

7.1 After the submission phase, three to five names (“finalists”) will be identified by the Selection Committee. Those finalists will be contacted by Badger Paddles via email. The winner will be decide by a public vote. If a potential winner cannot be reached after a reasonable effort has been exerted, he/she is found to be ineligible, he/she cannot or does not comply with these Official Rules, or if a prize notification is returned as undeliverable, such potential winner will be disqualified and an alternate potential winner may be selected at Sponsor’s sole discretion.

7.2 Individuals submitting paddle names irrevocably consent to the use of such finalists’ or winner’s name, likeness, image, voice, performance (in connection with interviews and other recordings), biographical information, and statements relating to the Contest or Sponsor without compensation.

7.3 The winner of the “voting phase” will be selected randomly from the list of eligible entrants as collected during the voting process. If a potential winner cannot be reached after a reasonable effort has been exerted, he/she is found to be ineligible, he/she cannot or does not comply with these Official Rules, or if a prize notification is returned as undeliverable, such potential winner will be disqualified and an alternate potential winner may be selected at Sponsor’s sole discretion.

7.4 Winner(s) may need to answer a skill testing question to qualify for their prize(s).

8. PRIVACY:

8.1 By participating in this Contest and submitting an entry, you:

(a) acknowledge that you understand that your personal information (including name and email address) is being collected by Badger Paddles and their partner(s) for the purposes of operating, administering and promoting the Contest; and

(b) consent to the disclosure of and access to your personal information, to the extent that your personal information appears in your entry, inside or outside of Canada, for any and all purposes in connection with your participation in, and the operation, administration and promotion of, the Contest. Your personal information will not be provided to any third parties, other than as provided in these Official Rules.

9. MISCELLANEOUS:

9.1 Badger Paddles reserves the right, without prior notice, to cancel, terminate or modify the Contest, including these Official Rules, for the purposes of clarification or if it cannot be operated, conducted or completed as planned, for any reason. If any term or provision of these Official Rules is invalid, illegal or unenforceable, all other terms and provisions of these Official Rules will nonetheless remain in full force and effect.

9.2 By participating, entrants agree

(i) to be bound by these Official Rules, including all eligibility requirements, and

(ii) to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Contest.

9.3 Badger Paddles, as manufacturer of the paddle, reserves the right, without prior notice, to change the name of the paddle at any time in the future without any liability whatsoever to the winner.

10. ASSIGNMENT OF RIGHTS TO PADDLE NAME

You agree that, by entering the Contest, you irrevocably assign and transfer to Sponsor all right, title and interest in the Paddle Name throughout the world, including, without limitation, all copyright, trademark or other intellectually property rights, and you agree to execute any additional documents Sponsor may deem necessary to evidence or effectuate such assignment if such need arrises.

11. LIMITATION OF LIABILITY

11.1 By entering this Contest, all entrants agree to release, discharge, and hold harmless Badger Paddles and its “selection committee”, partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

11.2 Badger Paddles assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Badger Paddles is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants’ or any other persons’ computers related to or resulting from participation, uploading or downloading of any materials related to in this Contest.

12. CONDITIONS

12.1 THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the country of Canada and the forum for any dispute shall be in the Ontario, Canada. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the entry to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

12.2 The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

12.3 If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Badger Paddles that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Badger Paddles reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsor elects to cancel or terminate the Contest, Sponsor will not retain any rights in the submitted Paddle Names and the paddle will be called “The Nipissing”.
